Florida's April 2026 criminal investigation into OpenAI's ChatGPT large language model, stemming from its alleged role advising a mass shooter, has prompted subpoenas and a related June civil lawsuit alleging deceptive safety practices. However, no federal charges or indictments have materialized by late August, and corporate criminal liability for AI developers remains rare absent clear proof of intent. Traders see the 74% probability of no charges in 2026 as reflecting the high evidentiary bar, limited scope of state actions so far, and OpenAI's resources to contest any escalation. Key upcoming catalysts include the Florida probe's findings and any Department of Justice signals.
